Kumasi Court Dismisses Akosua Serwaa’s Injunction on Daddy Lumba’s Funeral: Family Can Proceed Under Abusuapanin Guidance

The Kumasi High Court has struck down the injunction application filed by Akosua Serwaa Fosuh, the late highlife legend Daddy Lumba’s wife, paving the way for his family to proceed with funeral arrangements under the guidance of the Abusuapanin.
The ruling, delivered by Justice Dorinda Smith Arthur on Monday, rejects Serwaa’s bid to halt the rites and assert her exclusive rights as the sole widow, allowing the December 6 burial at Baba Yara Stadium to move forward.
Serwaa, married to Charles Kwadwo Fosuh (Daddy Lumba) in Germany in 2004, sought to bar family head Kofi Owusu Fosu, partner Priscilla Ofori Atta (Odo Broni), and Transitions Funeral Home from excluding her from decisions, claiming legal precedence.
However, the court upheld the family’s authority under customary law, stating that “authority over a deceased person’s body lies with the family.” This follows an October 24 Asanteman meeting where Nkosuohene Nana Osei Kwame Kyeretwie ruled Serwaa the only recognized widow, but Odo Broni—mother of Lumba’s six children—retains involvement.
The German Embassy’s October 27 confirmation of Serwaa’s marriage validity until Lumba’s July 26 death was noted, but the court prioritized Ghanaian customs for rites.
Lawyers for the family hailed the decision as “vindication,” with spokesperson William Kusi stating, “The family can now assign roles and honor Lumba’s legacy without delay.”
