Extradition Process Requires Formal Request and U.S. Court Approval – Legal Expert Explains

A legal expert has explained that extradition is a structured legal process that begins with a formal request from the requesting country to the state where the suspect is located.
According to him, extradition proceedings start when Ghana submits an official request to the United States, after which U.S. authorities assess whether the application meets all treaty obligations and domestic legal requirements.
He clarified that an arrest cannot be carried out solely for extradition purposes until U.S. authorities are satisfied that the request is valid under the law.
Once the preliminary assessment is completed, the matter proceeds to a U.S. federal court, not an immigration court. At this stage, a federal judge determines whether the extradition request is lawful and complies with applicable treaties and legal standards.
If the court upholds the request, the final step involves the surrender of the individual to the requesting state to face proceedings there.
The explanation comes amid public interest in extradition matters, with legal experts stressing that the process is governed strictly by international law and judicial oversight to protect the rights of all parties involved.
