Court Orders MSport to Refund GH¢364,000 Over Employee’s Betting Transactions

A High Court has ordered betting company MSport to refund GH¢364,000 to Gafat Consult Ltd after one of the company’s employees allegedly used an official corporate mobile money account for betting activities.

The case involved Benjamin Boateng, an employee of Gafat Consult, who reportedly registered on the betting platform using the company’s MTN MoMo number and used it for gambling transactions without authorization.

Following the discovery, Gafat Consult petitioned the Gaming Commission of Ghana in an effort to recover the funds, leading to legal proceedings at the High Court.

In its ruling, the court faulted MSport for what it described as inadequate verification and Know Your Customer (KYC) procedures. According to the judge, proper checks should have revealed that the mobile money number belonged to a corporate entity rather than an individual user.

The court further held that the betting company failed to conduct additional verification to confirm whether the employee had authority to operate the account on behalf of the company.

Based on those findings, the court ruled that MSport failed to meet regulatory standards required under the Gaming Commission’s guidelines and subsequently ordered the company to refund the GH¢364,000 to Gafat Consult Ltd.
