Accra High Court Upholds OSP Arrest Warrant Against Former Finance Minister Kenneth Ofori-Atta

Criminal Division of the Accra High Court dismissed an application by former Finance Minister Kenneth Ofori-Atta to quash an arrest warrant issued by the Office of the Special Prosecutor (OSP).

Ofori-Atta’s legal team argued that the OSP unlawfully obtained the warrant and sought to nullify all related proceedings, including an Interpol Red Notice alert.

The court, presided over by Justice Lydia Osei Marfo, ruled that the application lacked merit, affirming the validity of the OSP’s actions.

The OSP, led by Special Prosecutor Kissi Agyebeng, is investigating Ofori-Atta for alleged corruption, including procurement irregularities and financial misconduct during his tenure as Finance Minister from 2017 to 2024.

The warrant was initially issued after Ofori-Atta failed to appear for questioning in February 2025, prompting the OSP to declare him a fugitive. Although he was briefly removed from the wanted list after promising to return in May 2025, his non-compliance led to the reinstatement of the warrant and Red Notice.

This ruling is a significant victory for the OSP, allowing it to pursue its investigations and enforce the arrest warrant. Ofori-Atta’s family has claimed the OSP’s actions are politically motivated, but the court’s decision upholds the agency’s authority.

The Interpol Red Notice remains active, and the OSP is engaging international authorities to secure Ofori-Atta’s return to Ghana.
